    • I am buying a new home. Do I need title insurance?
      Title insurance is not required. If you have a mortgage, the mortgage company will likely require a title insurance policy. The title insurance the bank requires protects the bank and not the purchaser. Title insurance specifically protects from title issues and not other contract issues (for example, if mold were found in a basement after closing that was not previously disclosed, title insurance would not be helpful). Two of our attorneys can issue title insurance and can help you determine if a title insurance policy, and which policy, is right for you.
    • I do not want my children to have to pay for a probate proceeding. Can I make a plan to avoid probate?
      Yes. Trusts, Transfer on Death Deeds, Transfer on Death designations, and Payable on Death designations are all ways assets can be transferred after someone passes away without needing to probate. Each situation is unique and it is likely best to consult with a lawyer to ensure no assets are missed.
    • Can I protect my assets from a Medical Assistance lien?
      Yes, but it takes advanced planning. Talk with one of our attorneys to see what options are available to you.
    • Do I need a Will?
      Maybe. If you do not have a Will your property passes by something called intestacy or intestate. Intestacy is essentially a Will the state of Minnesota prepared for you. Having a Will also does not avoid probate, which can be a costly and lengthy court process. All attorneys in our office practice estate planning and can determine with you if a Will is necessary.
    • Do I need a lawyer to get divorced?
      No. You are not required to have an attorney for your divorce (called a dissolution of marriage in the court process). However, it is best to at least consult with an attorney and have an attorney review any agreements before you sign anything, including mediated agreements.
